Welcome to the website for the Daya Class Action Settlement Administration. The purpose of this website is to provide visitors with information relating to the settlement and the settlement claims process.

The Settlement

The Daya Class Action Settlement is for the benefit of women who underwent a Tompkins Metroplasty performed by Dr. Salim Daya at the Hamilton Health Sciences Corporation during the period January 1, 1990 to March 31, 2004, inclusive and certain members of their families.

The deadlines to opt out and to make a claim in this class action have passed.

Payments have been made to all 181 eligible Class Members from the Base Fund.

Payments of 176 Family Class Member claims have been made from the Family Class Fund, including payments into Court for all Family Class Members who are minors.

Payments have been made to all 56 eligible Class Members approved for additional compensation from the Additional Compensation Fund.

The distribution of the remaining surplus settlement funds to the 181 eligible Class Members was mailed February 13, 2013.

Class Members have six (6) months to cash the cheques they will be receiving with the final distribution, failing which the Court has ordered the Administrator to distribute any remaining funds to Women’s College Hospital.

The court has also directed that the 5 remaining contested Family Class Member awards proceed to written arbitrations.

The submissions required for the arbitrations have been collected and arrangements for the arbitrations are underway.
