Welcome to the website for the Daya Class Action Settlement Administration. The purpose of this website is to provide visitors with information relating to the settlement and the settlement claims process.

The Daya Class Action Settlement is for the benefit of women who underwent a Tompkins Metroplasty performed by Dr. Salim Daya at the Hamilton Health Sciences Corporation during the period January 1, 1990 to March 31, 2004, inclusive and certain members of their families.

The deadlines to opt out of this class action or to make a claim in this class action have run.

Payments have been made to all eligible Class Members from the Base Fund. Payments have been made on all uncontested Family Class Member claims. Payments were made into Court for all Family Class Members who are minors.

Fifty-eight claims for Additional Compensation were made under the settlement. Decisions have been received from Fund Counsel on 49 of these claims. Decisions on the 9 remaining Additional Compensation claims are expected to be rendered by August 10, 2010.

It is expected that the court will hear a motion concerning the 15 contested Family Class Member payments in September, 2010. At that time, the court will be asked to permit the payment of the remaining excess settlement funds to eligible Class Members.
