The settlement is for women who underwent a Tompkins Metroplasty performed by Dr. Salim Daya at the Hamilton Health Sciences Corporation during the period January 1, 1990 to March 31, 2004 and her family members.

The deadline to submit a claim for compensation has passed.

One hundred and eighty-one women were determined to be eligible Class Members and entitled to compensation.

Payments from the Base Fund, uncontested payments to eligible Family Class Members and the Additional Compensation payments were made some time ago.

Distribution of the surplus to the 181 eligible Class Members was mailed February 13, 2013.

Class Members have until August 15, 2013 to cash their surplus cheques, failing which the cheques will be cancelled and surplus monies distributed to Women’s College Hospital in accordance with the Court’s final distribution order.

Hearings will be held in writing with the Arbitrator for the 5 remaining contested Family Member Claims shortly.
